Warranty and manufacturer’s guarantee

travelite products are covered by both statutory warranty rights and a voluntary manufacturer’s guarantee. Both apply independently of one another.

1. Warranty and manufacturer’s guarantee – what is the difference?

Statutory warranty

The statutory warranty—also known as liability for defects—applies to the seller from whom you purchased the product. If you purchased your product from the travelite online shop, travelite is your seller. If you purchased it from another retailer, that retailer is generally your point of contact and contractual partner for warranty claims. The warranty covers defects that were already present when the product was handed over or whose cause was already inherent in the product at that time.

Voluntary manufacturer’s warranty

The travelite manufacturer’s warranty is a voluntary additional service provided by us as the manufacturer. You can find information about the warranty and our warranty terms on our products and via the following link: https://www.travelite.com/de/Garantie/. The manufacturer’s guarantee does not replace or limit your statutory warranty rights vis-à-vis the seller.

2. Statutory warranty

In the event of a valid, recognised warranty claim, you may initially request rectification from the seller. In principle, you may choose between repair and the supply of a replacement product free from defects. The seller may refuse your chosen method of rectification and select another method if your original choice is (e.g. technically) impossible or can only be carried out at disproportionate cost. The rectification is free of charge to you and must be carried out within a reasonable period of time.

Material defects, time limits and proof

Not every defect or damage to a product automatically constitutes a material defect and is therefore covered by the warranty. A material defect generally only exists if the product was already defective at the time of handover or if the cause of the defect that arose later was already present in the product at that time. Defects arising, for example, from normal wear and tear, improper use, overloading, a fall, impact, transport or other subsequent external influences are generally not material defects for which the seller is liable under the statutory warranty.

For new goods, statutory claims for defects in Germany generally lapse two years after the product has been handed over. The date of handover determines the start of this period. You must provide evidence of this by means of a proof of purchase, an invoice, an order confirmation or other suitable documentation. If a defect becomes apparent within one year of delivery, it is generally presumed in the case of a consumer goods purchase that this defect was already present at the time of delivery. However, this presumption does not mean that every defect occurring within this year is automatically covered by the warranty. In particular, this presumption does not apply if the nature of the damage or the goods is incompatible with a defect that was already present at the time of handover. After the first year has elapsed, the customer (you) must, as a general rule, prove that the material defect or its cause was already present at the time of handover.

A defect occurring within the two-year limitation period is only covered by the warranty if it is in fact a material defect that was already present or had arisen at the time of delivery. For purchases made outside Germany, different national time limits and rules regarding the burden of proof may apply.

3. Voluntary travelite manufacturer’s warranty

Your product is usually also covered by a voluntary manufacturer’s warranty. You can find information about this on or inside the product and at https://www.travelite.com/de/Garantie/. If your damage is covered by the warranty terms and conditions, you can claim the specified services, provided the conditions set out therein are met. To assess a warranty claim, we also require, in particular, proof of the original purchase. If the product was a gift, corresponding proof of purchase is also required.

Depending on the nature and extent of the damage, the product may be repaired or replaced under warranty. If there is no technically feasible or safe repair option, or if the product is no longer available in our range, travelite may provide an equivalent replacement product instead. A repair or replacement under the manufacturer’s warranty does not, as a rule, result in the warranty period being restarted or extended. The original purchase date remains the decisive factor.

A warranty claim does not, as a rule, give rise to a new statutory warranty period. Your statutory rights vis-à-vis the seller remain unaffected.

4. Examples of damage to luggage, bags and rucksacks

A warranty or guarantee claim may – depending on the cause of the damage and the applicable conditions – arise, for example, in the following cases...

  • Defects in materials and workmanship,
  • zips that are faulty,
  • seams that come apart without any external influence,
  • defective components or
  • the absence of an agreed quality.

The following items, in particular, are generally not covered:

  • normal wear and tear,
  • normal signs of wear and tear such as scratches, dents and scuffs,
  • Damage caused by overloading or improper use (whether by yourself or by third parties),
  • Damage caused by falls, impacts and other external influences, as well as
  • Damage caused in transit, for example during a journey by aeroplane, train or coach.

Whether a claim falls under the warranty or guarantee always depends on the cause of the damage, the condition of the product, the legal provisions and the applicable guarantee terms and conditions.

In a nutshell...

Warranty:

  • Statutory rights against the seller. These relate to defects that were already present or had arisen at the time of handover.

Manufacturer’s warranty:

  • Voluntary additional service provided by travelite in accordance with the applicable warranty terms and conditions. Your statutory rights remain unaffected.

Repairs under warranty:

  • The statutory limitation period is extended once by twelve months if the product is actually repaired as part of the rectification process.

Replacement under warranty:

  • If the remedy involves the provision of a replacement product, the special twelve-month extension does not apply; nor does a new two-year period commence automatically.

Repair or replacement under warranty:

  • The warranty period does not, as a rule, start afresh. The original date of purchase remains the determining factor.

If a defect becomes apparent within one year of handover, it is generally presumed in the case of a consumer goods purchase that this defect was already present at the time of handover. Depending on the nature and extent of the damage, the product may be repaired or replaced under the warranty. If there is no technically feasible or safe repair option, or if the product is no longer available in the range, travelite may instead provide an equivalent replacement product. A repair or replacement under the manufacturer’s warranty does not, as a rule, result in the warranty period starting afresh or being extended. The original date of purchase remains the determining factor.

A warranty claim does not, in principle, give rise to a new statutory warranty period. Your statutory rights vis-à-vis the seller remain unaffected.

Whether a warranty or guarantee claim applies always depends on the cause of the damage, the condition of the product, the statutory provisions and the applicable warranty terms and conditions.
