We use a consent management service ("Consent Manager Platform (CMP)") on our website to inform you about the cookies and other technologies we use on our website and to obtain, manage and document any consent you may have given to the processing of your personal data by these technologies. This is necessary pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR to fulfil our legal obligation pursuant to Art. 7 para. 1 GDPR to be able to prove your consent to the processing of your personal data, to which we are subject. We use technologies from service providers on our website whose registered office and/or server locations may be in third countries outside the EU or the EEA. If there is no adequacy decision by the EU Commission for this country, an adequate level of data protection must be ensured by means of other suitable guarantees.
Suitable guarantees in the form of contractually agreed standard contractual clauses of the EU Commission or binding internal data protection regulations (Binding Corporate Rules) are generally possible, but require prior verification by the contracting parties as to whether an adequate level of protection can be guaranteed. According to the case law of the ECJ, it may be necessary to take additional protective measures.
We have generally agreed the standard data protection clauses issued by the EU Commission with the technology providers we use who process personal data in a third country. Where possible, we also agree additional guarantees to ensure that sufficient data protection is guaranteed in third countries without an adequacy decision.
Notwithstanding the above, it may happen that, despite all contractual and technical measures, the level of data protection in the third country does not correspond to that of the EU. In such cases, we will ask you, if necessary, for your consent to transfer your personal data to a third country as part of the cookie consent process in accordance with Art. 49 para. 1 lit. a GDPR.
In particular, there is a risk that local authorities in the third country may not have sufficiently limited access rights to your personal data from a European data protection perspective, that we as the data exporter or you as the data subject may not be aware of this and/or that you may not have sufficient legal remedies to prevent this and/or to take action against such access.
The following countries in particular are currently categorised as third countries without an adequacy decision by the EU Commission (sample list):
- China
- Russia
- Taiwan
You can find out which third countries we transfer data to in the data protection information for the respective tool and/or service we use for consent management/ Consent Manager Platform (CMP).

Any further data processing will only take place if you have activated the "personalised advertising" setting in your Google account. In addition, other cookies stored in your browser by Google services are analysed. No personal data is read or saved from the input fields of the respective form.

However, this only takes place with your prior consent. The legal basis is therefore Art. 6 para. 1 sentence 1 lit. a GDPR. The session ID will be deleted after 365 days at the latest.
IV. Your e-mail address will be requested for any product recommendations sent by e-mail at your request. This will only be used by Neocom for the mailing you have requested. However, this will only take place with your prior consent. The legal basis is therefore Art. 6 para. 1 sentence 1 lit. a GDPR. We use the so-called "double opt-in procedure" for registration. After entering your e-mail address, you will receive an e-mail from us with a confirmation link to confirm your request to send the product recommendation. If you click on this confirmation link, your e-mail will be saved for the purpose of sending the e-mail. If you do not click on the confirmation link within 24 hours, your registration data will be blocked. You have the option to revoke your consent to the processing of personal data at any time in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR. If you contact us by email, you can object to the storage of your personal data at any time.
V. Neocom uses other services for product consulting. Details of these can be found here.

Personal information can also be transmitted. Please note that the use of free text input is voluntary and no sensitive information is required. These entries are processed - if technically necessary - and stored in accordance with recognised best practice standards, if necessary in anonymised or pseudonymised form. The data is encrypted at the access level according to the state of the art (AES-256). Processing takes place exclusively for the provision and optimisation of interactive product advice. In individual cases, data may be transferred to service providers in third countries outside the EU. In these cases, we ensure suitable guarantees in accordance with Art. 44 et seq. GDPR. The use of the AI-based variant is optional; alternatively, completely click-based use is still possible. The legal basis is your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR.

8.integration of the Trusted Shops Trustbadge/other widgets
If you have given your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, Trusted Shops widgets are integrated on this website to display Trusted Shops services (e.g. seal of approval, collected reviews) and to offer Trusted Shops products to buyers after an order.
The Trustbadge and the services advertised with it are an offer from Trusted Shops SE, Subbelrather Str. 15C, 50823 Cologne ("Trusted Shops"), with which we are jointly responsible under data protection law in accordance with Art. 26 GDPR. In the context of this data protection notice, we inform you below about the essential contents of the contract in accordance with Art. 26 para. 2 GDPR.
Within the scope of the joint responsibility existing between us and Trusted Shops SE, please contact Trusted Shops if you have any questions about data protection and to assert your rights, using the contact options provided in the data protection information. Irrespective of this, you can always contact the controller of your choice. If necessary, your enquiry will then be forwarded to the other responsible party for a response.
8.1 Data processing when integrating the Trustbadge/other widgets
The trust badge is provided by a US CDN provider (content delivery network). An adequate level of data protection is ensured in each case by an adequacy decision of the EU Commission, which can be accessed here for the USA. Service providers used from the USA are generally certified under the EU-U.S. Data Privacy Framework (DPF). Further information can be found here. If the service providers used are not certified under the DPF, standard contractual clauses have been concluded as a suitable guarantee.
When the Trustbadge is accessed, the web server automatically saves a so-called server log file, which also contains your IP address, the date and time of access, the amount of data transferred and the requesting provider (access data) and documents the access. The IP address is anonymised immediately after collection so that the stored data cannot be assigned to your person. The anonymised data is used in particular for statistical purposes and for error analysis.
8.2 Data processing after order completion
If you have given your consent, the Trustbadge accesses the order information stored in your end device (order total, order number, product purchased if applicable) and email address after the order has been completed and your email address is hashed using a cryptological one-way function. The hash value is then transmitted to Trusted Shops with the order information in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR.
This serves to check whether you are already registered for Trusted Shops services. If this is the case, further processing will take place in accordance with the contractual agreement concluded between you and Trusted Shops. If you are not yet registered for the services or do not give your consent to automatic recognition via the Trustbadge, you will then be given the opportunity to register manually for the use of the services or to complete the protection as part of your existing user contract.
For this purpose, the Trustbadge accesses the following information, which is stored in the end device you are using, after you have completed your order: Order total, order number and e-mail address. This is necessary so that we can offer you buyer protection. The data will only be transmitted to Trusted Shops if you actively decide to take out buyer protection by clicking on the correspondingly labelled button in the so-called Trustcard. If you decide to use the services, the further processing is based on the contractual agreement with Trusted Shops in accordance with Art. 6 para. 1 lit. b GDPR in order to complete your registration for buyer protection and to secure the order and, if necessary, to be able to send you evaluation invitations by e-mail afterwards.
Trusted Shops uses service providers in the areas of hosting, monitoring and logging. The legal basis is Art. 6 para. 1 lit. f GDPR for the purpose of ensuring trouble-free operation. Processing may take place in third countries (USA, Great Britain and Israel). An adequate level of data protection is ensured in each case by an adequacy decision of the EU Commission, which can be accessed here for the USA, here for the UK and here for Israel. Service providers from the USA are generally certified under the EU-U.S. Data Privacy Framework (DPF). Further information can be found here. If the service providers used are not certified under the DPF, standard contractual clauses have been concluded as a suitable guarantee.

6.3 Information on third country transfer (data transfer to third countries)

If the processing is carried out for other purposes, you only have the right to object if there are grounds relating to your particular situation. After exercising your right to object, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the establishment, exercise or defence of legal claims. This does not apply if the processing is for direct marketing purposes. In this case, we will no longer process your personal data for this purpose. |
